1. AGREEMENT TO TERMS

By accessing or using the DELETTO website, mobile application, or any other services offered by DELETTO Studio s.r.l. (collectively, the "Services"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Services.

2. DEFINITIONS

"DELETTO" refers to DELETTO Studio s.r.l., a company registered in Italy with its principal place of business at Cadore 9 Cap 20135, Milano (MI), Italy.

"Services" refers to the DELETTO website, mobile application, physical retail locations, made-to-measure and bespoke services, and any other services offered by DELETTO.

"User" refers to any individual who accesses or uses the Services.

"Client" refers to any User who makes a purchase or commission from DELETTO.

"Contract" refers to any purchase agreement concluded between DELETTO and the Client through the Services.

3. SCOPE OF APPLICATION

These Terms apply to all sales contracts and service agreements between DELETTO and Users who act as consumers (natural persons acting for purposes unrelated to their trade, business, craft, or professional activity) based on orders generated through our Services.

These Terms apply regardless of the User's nationality, provided that products are delivered to countries where DELETTO offers delivery services as listed on our website.

4. ELIGIBILITY AND ACCOUNT REGISTRATION

4.1 Age Requirement

The Services are intended for users who are at least 18 years of age. By using the Services, you represent and warrant that you are at least 18 years old.

4.2 Account Setup

To access certain features of the Services, you may register for an account by:

• Providing accurate, current, and complete information during registration
• Choosing a secure username and password (minimum 8 characters)
• Confirming acceptance of our privacy policy
• Verifying your email address

4.3 Account Security

You are responsible for maintaining the confidentiality of your login credentials. You must immediately notify DELETTO of any unauthorized use of your account by contacting our Legal Department. DELETTO is not liable for losses due to unauthorized account access resulting from your failure to secure your credentials.

4.4 Guest Purchases

Users may make purchases without creating an account by providing required information including name, delivery address, and contact details during the checkout process.

5. PRODUCT INFORMATION AND AVAILABILITY

5.1 Product Display

DELETTO makes every effort to display colors, textures, and details of our products as accurately as possible. However, we cannot guarantee that your device's display accurately reflects the actual appearance of products due to monitor settings and technical limitations.

5.2 Availability and Pricing

• All products and services are subject to availability
• Prices are subject to change without notice
• We reserve the right to modify or discontinue any product or service
• Products are available until stock is depleted
• If an ordered product becomes unavailable, we will notify you promptly and offer alternatives or full refund

5.3 Product Catalog

Users may only purchase products listed in our current online catalog. DELETTO regularly updates the product catalog without guaranteeing continuity of specific products, sizes, or color variations.

6. MADE-TO-MEASURE AND BESPOKE SERVICES

Made-to-measure and bespoke services require advance appointments. By scheduling an appointment, you agree to:

• Provide accurate measurements
• Attend scheduled fittings punctually
• Provide 24-hour advance notice for cancellations
• Pay required deposits as specified during consultation

7. ORDERS AND PAYMENT TERMS

7.1 Order Process

Your order constitutes a binding offer to purchase. The purchase contract is concluded when:

• We send order confirmation (if acceptance is expressly stated), or
• We dispatch the ordered products

7.2 Order Verification

Before confirming your order, verify all details carefully. Contact Customer Service immediately if you discover errors after order confirmation.

7.3 Payment Methods

We accept:

• Credit Cards (Visa, Mastercard, American Express, Maestro)
• PayPal
• Cash on Delivery (Italy only)

7.4 Payment Timing

• Credit card and PayPal: Payment due at order placement
• Cash on Delivery: Payment due upon product delivery
• Bespoke services: Non-refundable deposit required at consultation, balance due upon completion

7.5 Pricing

• Prices are displayed in Euros and include applicable VAT
• Prices may vary by delivery country
• Delivery costs and customs duties are additional and borne by the Customer

7.6 Right to Refuse Orders

DELETTO reserves the right to refuse or cancel orders, restrict access, or suspend accounts in cases of suspected service misuse, including:

• Excessive or unusual return patterns
• Repeated unfounded complaints
• Abuse of customer support services

8. DELIVERY AND SHIPPING

8.1 Delivery Process

Products are delivered to the address provided during order placement through contracted carriers. You will receive delivery confirmation with tracking information.

8.2 Delivery Locations

We deliver to countries listed on our website. Delivery times and costs vary by destination and are estimates only.

8.3 Delivery Inspection

Upon delivery, you must:

• Verify the number of packages matches transport documents
• Check packaging integrity
• Note any damage or tampering on delivery documents
• Report issues to Customer Service within 8 days of delivery

8.4 Failed Deliveries

If delivery fails due to your absence, the carrier will hold products at their facility for the specified timeframe. Uncollected products will be returned to DELETTO, resulting in contract termination and refund minus applicable costs.

9. RETURNS AND WITHDRAWAL RIGHTS

9.1 Right of Withdrawal

You have the right to withdraw from the contract without explanation within 14 days from:

• Contract conclusion, or
• The day you (or your designated third party) takes physical possession of the products

9.2 Withdrawal Process

To exercise withdrawal rights:

• Clearly communicate your intention to withdraw
• Return products within 14 days of withdrawal notification
• Products must be in original condition with unremoved labels
• Return shipping costs are borne by the Customer unless otherwise agreed

9.3 Refund Process

Upon valid withdrawal:

• Full refund processed within 30 days
• Refunds made using original payment method
• Additional delivery costs (if premium delivery chosen) excluded from refund

10. LEGAL GUARANTEE OF CONFORMITY

10.1 Guarantee Coverage

Products are covered by legal guarantee of conformity for 2 years from delivery date.

10.2 Non-Conformity Claims

You must notify DELETTO of any non-conformity within 2 months of discovery. We will provide repair, replacement, price reduction, or contract cancellation as appropriate.

10.3 Guarantee Exclusions

The guarantee does not cover damage caused by:

• Accidental damage
• User misuse
• Use inconsistent with product purpose

11. INTELLECTUAL PROPERTY

11.1 DELETTO Content

All content on the Services, including text, graphics, logos, images, and software, is the property of DELETTO or its licensors and is protected by intellectual property laws.

11.2 Limited License

Subject to these Terms, DELETTO grants you a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes.

11.3 Trademark Notice

DELETTO, the DELETTO logo, and related marks are trademarks of DELETTO. You may not use such marks without prior written permission.

12. PROHIBITED CONDUCT

You agree not to:

• Use the Services for illegal purposes
• Violate applicable laws or regulations
• Infringe rights of others
• Interfere with or disrupt the Services
• Attempt unauthorized access to the Services
• Use automated systems to access the Services
• Engage in conduct that restricts others' use of the Services

13. USER DECLARATIONS AND WARRANTIES

You declare and warrant that you:

• Are legally capable of agreeing to these Terms
• Are over 18 years of age
• Have provided truthful and accurate information
• Will use the Services in compliance with applicable laws

14. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

15. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DELETTO SHALL NOT BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

16. INDEMNIFICATION

You agree to indemnify and hold harmless DELETTO and its officers, directors, employees, and affiliates from claims arising from your violation of these Terms or use of the Services.

17. PRIVACY AND PERSONAL DATA

DELETTO processes your personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference and available on our website.

18. TERMINATION

DELETTO may terminate or suspend your access to the Services immediately for any reason, including breach of these Terms. Upon termination, your right to use the Services ceases immediately.

19. GOVERNING LAW AND DISPUTE RESOLUTION

19.1 Applicable Law

These Terms are governed by Italian law.

19.2 Jurisdiction

Disputes shall be resolved exclusively in the courts of Vicenza, Italy, except where consumer protection laws provide otherwise.

19.3 Online Dispute Resolution

EU consumers may access the European Commission's Online Dispute Resolution platform at: https://ec.europa.eu/consumers/odr/

20. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms with a new "Last Updated" date. Your continued use of the Services constitutes acceptance of modified Terms.
